These Terms of Service govern your use of the website and applications operated by Lomond Co, LLC ("Lomond Co," "we," "us"). By using our services, you agree to these terms.
You must be at least 18 years old and able to enter into a binding contract. You agree to provide accurate information and to keep your account credentials secure. You are responsible for activity that occurs under your account.
These terms apply to the Lomond Co website and to our applications. Sections 3 through 5 concern our land-access marketplace, HuntBNB, and apply only to that product.
Vice Guide is an independent, unofficial companion application. Lomond Co is not affiliated with, endorsed by, sponsored by, or officially connected to Rockstar Games, Take-Two Interactive Software, Inc., or any of their subsidiaries or affiliates. Grand Theft Auto and all associated names, logos, and marks are the trademarks of their respective owners and are used here only nominatively, to identify the game our app is a companion to. All maps, artwork, text, and other content in Vice Guide are original works created by Lomond Co.
Our marketplace connects landowners offering access to their property with individuals seeking that access. Lomond Co is not a party to any access agreement between a landowner and a user. We do not own, control, inspect, or manage any property listed on the platform. We are not a guide service, an outfitter, an insurer, or a real estate broker.
Access fees are set by the landowner. Lomond Co may charge a service fee, which will be disclosed before you complete a booking. Payments are handled by a third-party payment processor. Cancellation and refund terms will be presented at the time of booking and form part of the agreement between the parties.
We may suspend or terminate accounts that violate these terms.
You retain ownership of the photographs, descriptions, and other content you upload. You grant Lomond Co a non-exclusive, worldwide, royalty-free license to host, display, and reproduce that content for the purpose of operating and promoting the service. You represent that you have the rights to the content you post.
Our services are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that listings are accurate, that properties are safe, or that any booking will meet your expectations.
To the fullest extent permitted by law, Lomond Co and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, arising out of or related to your use of the services or any interaction with another user, whether based in contract, tort, or any other theory. Our aggregate liability for any claim relating to the services will not exceed the greater of the amount of fees you paid to us in the twelve months preceding the claim, or one hundred United States dollars.
You agree to indemnify and hold harmless Lomond Co from claims, damages, and expenses, including reasonable attorneys' fees, arising out of your use of the services, your violation of these terms, or your violation of any law or the rights of a third party.
These terms are governed by the laws of the State of Utah, without regard to its conflict of laws rules. The parties agree to attempt to resolve any dispute informally before pursuing formal action, and to the exclusive jurisdiction of the state and federal courts located in Utah.
We may update these terms. We will revise the date above and, for material changes, provide notice before they take effect. Continued use after the effective date constitutes acceptance.
